GENERAL TERMS AND CONDITIONS
KATRIENETTE is a brand name of DAFRALU BV with registered office at Bethaniënlei 167 in Zoersel, Belgium and is registered in the Belgian Crossroads Bank of Enterprises under number 0542 493 680 as well as at Belgian Legal Persons Register of Turnhout. The VAT number is BE 0542.493.680. Also reachable via e-mail: firstname.lastname@example.org.
Each order placed is considered as acceptance by the buyer of our general terms and conditions, which form an integral part of the agreement, to the exclusion of all other general or special terms and conditions emanating from the seller, which are always part of an express written document.
All mentioned prices are expressed in EURO, always including VAT and all other compulsory taxes to be borne by the buyer. If delivery, reservation or administrative costs are charged, this will be stated separately.
- Quotes and acceptance of order
All our quotations are without obligation. We are only bound by an order after we have confirmed it in writing or after we have started to execute it. The product and pricing information, as well as detailed order information, have been drawn up and communicated subject to change and correction.
Despite the fact that the website is compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains factual errors, or is not up to date. Obvious mistakes or errors in the offer do not bind KATRIENETTE. KATRIENETTE is, as far as the correctness and completeness of the information provided is concerned, only bound to an obligation of best efforts. KATRIENETTE shall under no circumstances be liable in the event of manifest factual errors, typesetting or printing errors.
After placing the order, the buyer will receive an automatically generated email with the confirmation of his order. If an article is no longer in stock, the buyer will be notified within two working days. Orders can only be placed via the internet site of KATRIENETTE. No orders or changes to orders placed online will be accepted by phone, email, facebook, messenger, instagram or any other media.
- Workshops and events
A booking for a workshop or event is only final after an order has been placed and payment has been received. When the payment has been made and the workshop or event is canceled by KATRIENETTE (e.g. due to insufficient participants or force majeure), the payment can serve as a reservation for the next workshop (whether or not the same – at your own choice) or be refunded within 14 working days to the account number known in the database of our web shop.
The entry fee for workshops and events will not be refunded in the event of cancellation or absence, unless this place is filled in on time. The buyer may also send someone other than himself.
- Method of payment
Payments should always be made in one transaction. When paying for the order, the buyer can choose between different payment options. Payment can be made via Bancontact, iDeal or PayPal.
- Right of withdrawal
Workshops and events:
The right of withdrawal, whereby the consumer has the right to cancel the purchase within 14 calendar days, does not apply according to Belgian Code of Economic Law Article VI.53, 13°. The subject matter of the contract, namely the organization of workshops and events, qualifies as services relating to leisure activities and is therefore excluded from the right of withdrawal.
Digital content (PDF files, publications, digital patterns, …):
- Offers and discounts, Gift vouchers
Offers are without obligation, unless otherwise stated. Offers and discounts are limited in time. Discounts may be personal and therefore are not transferable to third parties. Discounts and/or offers may not be cumulated. So there will always be only 1 discount ( either discount in amount or as a percentage) granted per order. Discounts are not convertible into cash. KATRIENETTE has the right to unilaterally change or cancel discounts due to force majeure, mistakes or errors.
These conditions apply to all gift vouchers issued by Katrienette.
Each Gift Voucher is provided with a unique code. This can be a number code and/or text code. Each Gift Voucher is issued only once. You should carefully preserve the Gift Voucher (including the code). In the event of theft (including the use of the code by unauthorized third parties) or loss (including the (accidental) deletion of e-mails), no compensation will be paid.
In order to use a Gift Voucher, you need to place your selected products in the “shopping basket”. During the payment process, enter the exact code in the field under “Do you have a Gift Voucher” and then press the “add to basket” button. Then you go to “proceed to checkout” to continue the purchase process.
The nature, value, duration, expiry date and/or any other applicable specific terms and conditions of use can be found on the Gift Voucher and/or in the statement (e-mail) in which the code is included. Each Gift Voucher is valid for a maximum of one year. After the expiry date, the Gift Voucher can no longer be used. Gift vouchers issued by Katrienette are only redeemable for purchases via www.katrienette.be. Gift vouchers cannot be used for outstanding orders. Gift vouchers or their residual value are not convertible for cash.
The residual value of the Gift Voucher can be used for future orders. This value is visible in the user’s account. The residual value is non-transferable and can only be used from the same account where the Gift Voucher was first used and during the period of validity of the Gift Voucher. For Gift Vouchers that have already been used, all information regarding code, residual value and expiry date is also available via the “my account” page on the Katrienette website. If the total amount of the order exceeds the value of the Gift Voucher(s) used, the difference must be paid with one of the other payment methods: Bancontact, iDeal or PayPal.
- Force majeure
We shall not be liable if we are unable to fulfill our obligations as a result of force majeure. Force majeure is understood to mean any strange cause or circumstance that prevents KATRIENETTE from fulfilling its obligations: delay or breach of contract by suppliers and deliverers, disruptions in the Internet, disruptions in electricity, disruptions in e-mail traffic and disruptions or changes in technology supplied by third parties, transport difficulties, strikes, government measures, delays in supply, negligence by suppliers and/or manufacturers or auxiliary persons, illness of personnel, defects in auxiliary or transport equipment and delivery explicitly count as force majeure. In the event of force majeure, KATRIENETTE reserves the right to suspend its obligations and is also entitled to dissolve the agreement in whole or in part, or to demand that the content of the agreement be changed in such a way that fulfillment remains possible. Under no circumstances is KATRIENETTE obliged to pay any fine or compensation. If KATRIENETTE has already partially fulfillled its obligations, or can only partially fulfill its obligations, KATRIENETTE shall be entitled to invoice the goods already delivered separately and the buyer shall be obliged to pay this invoice as if it were a separate contract.
- Personal data & use of images
By ordering on the internet site of KATRIENETTE, the buyer explicitly allows pictures and video recordings of participants to be made during workshops and events. Publishing non-posed, spontaneous photos and atmospheric images – in which the participant may be recognizable – via the website and social media is only done if the buyer has explicitly agreed to this during the order process. For focused (posed) photographs we need your explicit permission according to the privacy law.
All parties accept electronic evidence within the framework of their relations (e.g. e-mail, backups, …).
- Affection validity – non renunciation
If a provision in an article of these terms and conditions is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.
Failure by KATRIENETTE at any time to enforce any of the rights listed in these Terms and Conditions, or to exercise any right hereof, shall never be construed as a waiver of such provision and shall never affect the validity of these rights.
- Applicable law
All agreements concluded with the seller are regulated by Belgian law. In the event of any disputes, only the courts of Antwerp shall be competent.
Katrienette reserves the right to change the conditions at any time and without notice.
